Filed: September 18, 2017 ◆§ 2:17-cv-01223-MRH

R&R Express, Inc. is facing a former employee's claims that the logistics company failed to pay proper wages in violation of the Fair Labor Standards Act and Pennsylvania labor laws. The plaintiff says he worked for the defendant as a logistics coordinator and was promised $800 per week for the first 90 days of his employment, after which he would be paid only commissions. According to the suit, his pay structure did not change until well after the 90-day period was over, and he was then told that he must repay the defendant from his future commissions all money he earned while he was given a fixed salary. The plaintiff argues that he never agreed to repay this “deficit,” which he says totaled approximately $17,000, and never would have agreed had he been told this at his time of hire.
The suit argues that the defendant denied the plaintiff proper overtime wages for all the hours he worked above 40 each week and, on top of that, failed to pay him as promised.
