First & Finest Deli Corp. and an individual owner are facing claims that they failed to pay their employees proper wages and neglected to provide them with accurate wage documents.
First & Finest Deli Corp. and an individual owner are facing claims that they failed to pay their employees proper wages and neglected to provide them with accurate wage documents. In a proposed collective action, a former delivery driver alleges that the defendants paid him less than the tip-credited rate and argues that he spent more than 20% of each day performing non-tipped duties, entitling him to the full minimum wage. The plaintiff further claims that he is owed overtime wages for the hours above 40 that he worked each week and spread-of-hours wages for each shift that lasted longer than 10 hours.
According to the lawsuit, the defendants also failed to provide accurate wage notices when the plaintiff was hired and neglected to record his hours and rate of pay in weekly wage statements.
