Lucky 99 Cent Shop Inc. and an individual with control of the business have been named in a proposed collective action filed by a former employee over potential labor law violations. At issue in the lawsuit is the defendants’ alleged failure to pay employees time-and-a-half overtime wages for all hours worked in excess of 40 each week. The plaintiff says she was employed as a cashier, stocker, and laborer and regularly worked 55 hours per week without receiving premium wages. The case further claims the defendants failed to post notices informing employees of their labor rights under federal and state law.
