A former Kalida Manufacturing forklift operator has filed a lawsuit against the company in which he claims his overtime pay rate was miscalculated.
An individual formerly employed as a forklift operator by Kalida Manufacturing has filed a proposed collective and class action against the company in which he claims his overtime pay rate was miscalculated.
Filed in Ohio, the case alleges the plaintiff and similarly situated workers were not paid properly for all hours worked as a result of the defendant’s failure to correctly calculate their regular rates of pay “for the purposes of meeting the minimum requirements set forth” in the Fair Labor Standards Act (FLSA). More specifically, the plaintiff claims Kalida Manufacturing, when tallying overtime pay, only included workers’ base hourly wages in their “regular rate of pay” and left out additional forms of compensation, such as non-discretionary attendance bonuses and job safety bonuses.
“Instead, [the defendant] paid Named Plaintiff and other similarly situated employees overtime compensation at one and one-half times their Base Hourly Wage and not one and one-half times their regular rate of pay, as that phrase is defined under the FLSA,” the lawsuit reads.
