Former Dunkin Donuts Employee Sues for Allegedly Unpaid Overtime, Retaliation

A lawsuit has been filed against TC Payroll and one individual supervisor for allegedly withholding overtime wages and issuing a retaliatory discharge.
A lawsuit has been filed against TC Payroll, LLC and one individual supervisor for allegedly withholding overtime wages and firing the plaintiff in retaliation for complaining about certain salary issues. The plaintiff was a store manager at a Martin County, Florida Dunkin Donuts franchise owned and operated by the defendants, the lawsuit says. The case argues that although the plaintiff was assigned both managerial and non-managerial duties, many of her managerial decisions were overturned. Furthermore, the plaintiff claims she spent most of her time performing non-managerial tasks. As such, the case argues that the plaintiff met the requirements of a non-exempt employee and was therefore entitled to the overtime protections afforded by the Fair Labor Standards Act. According to the lawsuit, however, the plaintiff worked at least 48 hours per week without proper overtime pay.
The lawsuit further alleges that improper deductions were made from the plaintiff’s salary for medically related absences. When the plaintiff complained about these deductions to the defendants, she was fired, according to the complaint. The plaintiff seeks compensation for her allegedly unpaid wages, as well as her discharge.
