The companies and individuals who operate Fadaro Fancy Foods, Corp. are facing a proposed collective action filed by a former employee.
The companies and individuals who operate Fadaro Fancy Foods, Corp. are facing a proposed collective action filed by a former employee who says he wasn’t paid proper overtime wages. The man allegedly worked as a driver at the defendants’ Bronx Terminal Market location and was required to put in more than 40 hours of work per week for a fixed weekly salary of $1,000.00. He claims the defendants not only failed to pay him mandated time-and-a-half premium wages for an estimated 23 to 26 hours of overtime worked per week, but were sometimes late in issuing his paychecks. On top of that, the man alleges the defendants unlawfully deducted about $400 from his wages for fines he supposedly accrued while performing his job duties.
Additionally, the suit claims the plaintiff was never provided with required breaks; posted notices regarding his employment rights; accurate wage statements; and reimbursement for purchasing clothing items needed to perform his job.
