Gulf Distributing Co. of Mobile, LLC is on the receiving end of a proposed class action filed by a former employee who claims he was not paid proper wages and was unlawfully terminated while on leave.
Gulf Distributing Co. of Mobile, LLC is on the receiving end of a proposed class action filed by a former employee who claims he was not paid proper wages and was unlawfully terminated while on leave. The plaintiff says he worked for the defendant as a draft technician and was responsible for cleaning draft beer lines for the brewing companies his employer contracted with. According to the suit, the plaintiff and similarly situated employees often worked more than 40 hours per week without receiving time-and-a-half overtime pay. On top of that, the defendant allegedly required employees to “volunteer” at off-site events such as festivals without paying them any wages at all.
The plaintiff also brings an individual claim against the defendant, alleging that he was unlawfully fired while on leave under the Family Medical Leave Act. He claims his termination was in direct retaliation for voicing his complaints about the defendant’s pay practices, which the suit says violates the Fair Labor Standards Act.
