Mississippi County, Arkansas, is the defendant in a proposed class and collective action filed by a former deputy sheriff who claims he’s owed unpaid overtime wages.
According to the complaint, the plaintiff worked for the defendant from March 2011 through early July 2018. The man claims he and similarly situated deputy sheriffs, jailers and detention center employees were routinely required by Mississippi County to work in excess of 171 hours across a 28-day period despite the absence of any clearly defined “work period.” These employees were required by the defendant to work more than 40 hours per week without time-and-a-half pay, the case claims.
“The actual day-to-day job duties and responsibilities of [the plaintiff], other Deputy Sheriffs, Jailers and similar detention center employees were not exempt under the [Fair Labor Standards Act] with respect to payment for time worked in excess of forty (40) hours per week, or alternatively 171 hours in a 28-day period,” the suit reads.
