Former Customer Service Reps Claim Univar Issued Comp Time Instead of Overtime Wages

Three former customer service reps allege Univar issued "comped" days off rather than pay time-and-a-half hourly overtime wages.
Three individuals formerly employed as customer service representatives (CSRs) by Univar Inc. and Univar USA Inc. have filed a proposed collective action against the chemical and ingredient distributor over its alleged failure to pay overtime wages. Citing suspected Fair Labor Standards Act violations, the plaintiffs claim Univar, rather than pay time-and-a-half for all hours worked past 40 each week, instead issued customer service reps time off the following workweek—“comp time”—equal to the number of overtime hours worked.
“For example, if a CSR worked fifty hours the first week of his pay period, he was prohibited from working in excess of thirty hours the second week of his pay period,” the complaint explains.
The case says that the workers were required to use the comp time and could not “opt for overtime pay in the week in which the overtime hours were worked.”
