Express Courier International, Inc. and EMP LSO Holding Corporation have been named as defendants in a proposed class action lawsuit that claims the parties misclassified their couriers as independent contractors and neglected to pay them proper overtime wages. The plaintiff says he worked as a courier for the defendants’ package delivery business and was required to adhere to his employers’ strict guidelines concerning his uniform, pricing, customer complaints, and various other aspects of his job. As a result, the suit alleges, the plaintiff should have been considered an employee and granted the associated benefits outlined in the Fair Labor Standards Act, such as premium wages for all hours worked over 40 in a week.
