A long time chef for West J&R Inc., which does business as Da Rosina Ristorante Italiano in New York City recently filed a proposed class action against his employer.

A named plaintiff who worked long days as a cook for West J&R Inc., which does business as Da Rosina Ristorante Italiano in New York City, alleges in a proposed collective action that the defendants (the restaurant and one named individual) failed to pay him and similarly situated employees proper overtime wages. According to the complaint, which cites alleged Fair Labor Standards Act (FLSA) violations, the plaintiff typically worked around 54 hours per week without being paid at the time-and-a-half overtime rate for all hours worked past 40. The plaintiff further alleges he was always paid his wages in cash and was never required to keep track of his hours worked.
