Three operating companies and four individual owners of Trattoria Spaghetto are facing a proposed collective action filed by a former employee who claims he was not paid proper overtime wages. According to the complaint, the plaintiff was employed as a cook at the defendants’ Italian restaurant between July 2016 and June 2017, and regularly worked about 52 hours per week without receiving overtime wages for the hours he worked beyond 40. In alleged violation of the New York Labor Law, the man was denied wage statements for each pay period and was required to purchase four pairs of kitchen shoes – items required to perform his duties – without reimbursement, according to the case.
