A former Canaan Sushi Inc. employee has filed a lawsuit against the company and two individuals who control the business in which he claims he wasn’t paid proper wages while working at the defendants’ sushi restaurant. The plaintiff says he was employed as a delivery worker and put in 64.75 hours per week without receiving proper minimum, overtime, or spread-of-hours wages. According to the lawsuit, the defendants unlawfully failed to inform the man that a tip credit was applied to his wages and paid him a fixed rate of $1,000 per month no matter how many hours he worked. The plaintiff says he was required to spend a significant portion of his time performing non-tipped duties, which the case says should have precluded the defendants from claiming a tip credit.
Additionally, the case argues that the defendants owe the plaintiff reimbursement for purchasing a $1,500 electric bicycle that was required to perform his job duties.
