The operating company of Café Cosina Restaurant and two individual owners are facing a proposed collective action filed by a former delivery driver who claims he is owed unpaid wages. The plaintiff says the defendants applied a tip credit to his wages despite requiring him to spend more than 20 percent of each day performing non-tipped duties such as washing dishes and cleaning.
On top of that, the complaint alleges, the plaintiff was not provided with premium wages for the hours he worked over 40 each week or over 10 each day. According to the suit, he typically worked as many as 73 hours per week without receiving appropriate minimum, overtime or spread-of-hours wages.
Furthermore, the defendants allegedly failed to provide the plaintiff with meal breaks and required him to purchase “tools of the trade” – such as a bicycle, chain, and lock – without reimbursing him for his expenses.
