Cate Star, LLC and an individual with control over the business are defendants in a proposed collective action filed by a former employee who claims she is owed unpaid minimum and overtime wages. The plaintiff – who was employed as a kitchen assistant/runner at the defendants’ restaurant Buffet City – says she worked an average of 72 hours per week without being paid time-and-a-half overtime wages for the hours she worked above 40. Even further, she claims she was paid $6.94 per hour, which the complaint notes is below the mandated minimum wage. According to the suit, the defendants “failed to investigate whether their payroll practices were in accordance with the Fair Labor Standards Act” despite knowing they were required to comply with it.
