Astoria, New York’s Z Bar is facing a proposed collective action filed by a former cook who claims he wasn't paid proper minimum, overtime, and spread-of-hours wages.
The operating company of Astoria, New York’s Z Bar is facing a proposed collective action that takes issue with the bar’s alleged pay practices. Also filed against four individual owners, the lawsuit claims the defendants failed to pay a former cook proper minimum, overtime, and spread-of-hours wages.
The plaintiff in the case says he was employed at Bar Z between May 2015 and June 2018 and regularly put in more than 40 hours per week without receiving extra pay for his overtime hours or shifts that lasted longer than 10 hours in a day. Though the man was allegedly paid $11.00 per hour, he claims he often worked 15 minutes past the end of his scheduled shifts without being paid for the extra time and therefore didn’t receive the full minimum wage for each hour worked.
On top of the potential wage violations, the lawsuit also argues that the plaintiff wasn’t provided with proper meal and rest breaks, accurate wage statements, nor reimbursement for purchasing clothes he was required to wear to perform his job.
