A former server and bartender at a Virginia Applebee’s has filed suit against the restaurant’s operating company over claims that it owes her unpaid wages.

A former server and bartender at a Virginia Applebee’s has filed suit against the restaurant’s operating company over claims that it owes her unpaid wages. The defendant, Potomac Family Dining Group Operating Company LLC, allegedly operates 69 Applebee’s locations across several states and, according to the suit, requires its employees to work “off the clock,” fails to pay them proper minimum wages, and miscalculates their overtime pay.
The plaintiff says she was often required to wait until her first customer arrived before she was permitted to clock in and was forced to perform various duties after clocking out, causing her to work many hours for which she was not compensated. She further argues that the defendant frequently altered her time records and paid her for fewer hours than she actually worked.
In addition, the suit claims the defendant required tipped employees to spend a significant portion of time performing non-tipped duties, meaning the company was not eligible to take a tip credit from their wages. On top of that, the plaintiff says the defendant miscalculated her overtime pay using a tip-credited rate. As a result of the defendant’s allegedly illegal pay practices, the plaintiff says she is owed unpaid minimum and overtime wages.
