Filed: December 19, 2017 ◆§ 1:17cv7385
Two former employees of Bay Terrace Plaza LLC have filed suit against the company and two individual owners over claims that they were not paid proper wages while working at the defendants’ restaurant.
New York
Two former employees of Bay Terrace Plaza LLC have filed suit against the company and two individual owners over claims that they were not paid proper wages while working at the defendants’ restaurant. The plaintiffs say they worked as food runners, bussers, and cleaners at Allora Italian Kitchen & Bar and were paid $7.50 per hour plus tips. Though both plaintiffs claim they worked at least 50 hours per week, and sometimes up to 61, they were allegedly only paid for 30, on average. According to the suit, they were also denied time-and-a-half overtime wages for the hours they worked above 40 each week.
On top of the alleged wage violations, the complaint argues that the defendants failed to provide accurate wage statements and neglected to post required notices informing employees of their rights under state and federal law.
