Bautista Morales et al v. Mbg Taverns Inc et al
Filed: July 17, 2018 ◆§ 1:18cv6431
A proposed collective action claims employees at The Storehouse, an Irish pub in New York City, weren't paid proper wages.
A proposed collective action has been filed against MBG Taverns Inc. and two individual owners over claims that the parties failed to pay their employees proper wages.
The lawsuit says that the defendants operate an Irish-style pub in New York City called The Storehouse at which the two named plaintiffs were employed. The men say they worked as a cook and sous-chef, respectively, and frequently put in more than 40 hours of work per week without being paid appropriate overtime or spread-of-hours wages. On top of that, the case alleges that the plaintiffs sometimes worked additional time beyond their scheduled shifts without being paid any wages for the extra hours. Adding to the supposed wage infractions, the plaintiffs claim the defendants automatically deducted $22.50 per week from workers' paychecks for meals breaks they were never able to take.
Rounding out the case, the complaint argues that the defendants altered the workers’ paystubs to reflect they had put in fewer hours than they actually worked.
