A proposed class action claims juvenile detention facility operator South Arkansas Youth Services, Inc. failed to pay employees rightful time-and-a-half OT.
South Arkansas Youth Services, Inc., a juvenile detention facility that houses moderate to severe offenders, and its director are the defendant in a former employee’s proposed collective action that alleges the parties failed to pay proper wages in violation of the Fair Labor Standards Act (FLSA). The plaintiff, who worked for the defendants as a “team leader” from May 2002 through December 2016, alleges he and similarly situated workers were not paid rightful overtime wages as a result of being improperly classified by the defendants as independent contractors exempt from time-and-a-half pay for all hours worked over 40.
