A former 25-year maintenance worker claims Reliant Realty Services and two other companies owe unpaid overtime wages.

Full-service property management company Reliant Realty Services, LLC and two others are on the receiving end of a former 25-year maintenance worker’s proposed class action alleging he is owed unpaid overtime wages. The lawsuit, which also names Reliant Realty Services, Inc. and 690 Gates, L.P. as defendants, alleges the plaintiff worked 48 hours each week, possibly more, on buildings owned by the companies in Brooklyn, New York without being paid for all hours worked.
The complaint notes the plaintiff was required to be on-call after his regular shifts to work as needed, which usually amounted to roughly three additional work hours per week. According to the suit, the plaintiff was not paid for this additional work time.
What’s more, the defendants allegedly required the plaintiff to live in one of their buildings so he would be available to other tenants at all hours of the day. This is where the lawsuit gets somewhat complicated, as the defendants alleged “paid for certain overtime hours they chose to pay for,” the rate for these extra hours allegedly “did not include the value of the apartment” provided to the plaintiff. The case points out that under the Fair Labor Standards Act (FLSA), the housing provided by an employer to an employee “in addition to cash wages at the reasonable cost of the fair value of the lodging (per week) must be added to the cash wages before the regular rate is determined.”
