Medix Staffing Solutions, Inc. is facing a former credentialed trainer's accusations that it failed to pay her proper overtime wages.
Medix Staffing Solutions, Inc. is facing a former employee’s accusations that it failed to pay her proper overtime wages. In a proposed class action lawsuit, the woman claims she was employed as a credentialed trainer responsible for providing IT support and training the defendant’s clients at various medical facilities on how to use the company’s software. According to the suit, the plaintiff was misclassified as exempt from receiving overtime pay even though her main responsibilities were allegedly non-managerial in nature and were not considered “computer systems analysis, programming or software engineering.” She argues that she should have been paid time-and-a-half premium wages for all the hours she worked above 40 each week as required by the Fair Labor Standards Act (FLSA).
