Alvarez v. Torchav, Inc. et al.
Filed: October 3, 2017 ◆§ 1:17-cv-23617-CMA
A bakery assistant claims Lucerna Bakery owes him and other workers unpaid time-and-a-half overtime wages.
A proposed collective action out of Florida alleges Torchav, Inc., the operating company behind Lucerna Bakery, and one individual with control over the business owe unpaid overtime wages. The plaintiff, who the complaint says works as a bakery assistant and customer attendant, alleges he’s worked an average of 52 hours per week since August 2016 for $3.85 per hour but was never paid time-and-a-half hourly wages for all hours worked over 40. The case alleges the defendants’ willful refusal to pay overtime violates the Fair Labor Standards Act.
