A lawsuit against Yuzu Kaiten Sushi and one individual claims that the defendants failed to appropriately compensate all “servers/waitpersons” at their Florida restaurant.
A proposed collective action filed in Florida against Yuzu Kaiten Sushi LLC and one individual who collectively own and operate a Fort Lauderdale restaurant claims that the defendants failed to appropriately compensate all “servers/waitpersons.”
The lawsuit alleges that the defendants maintained a policy of unlawfully requiring servers to pool their tips and then partially distributing the money among management and non-tipped employees, such as kitchen workers and other back-of-the-house workers. For this reason, the suit argues, the defendants were not permitted to apply a tip credit to servers’ wages.
On top of that, the plaintiff says she was required to perform non-tipped “side work,” such as cleaning windows, tables and floors, which further precluded her employers from paying her less than the full minimum wage, according to the lawsuit.
The plaintiff seeks to recover “an additional $3.02 per hour for her regular hours worked as repayment for the tip credit improperly deducted from her wages, the amount of her tips improperly shared with traditionally non-tipped employees, as well as an additional $3.02 per hour for hours worked performing side work that was not incidental to tip producing activities, along with liquidated damages in an amount equal to her unpaid minimum wages.”
