Vehicle repossession company American Recovery Specialists of Florida, Inc. is on the receiving end of a proposed class action claiming the company failed to pay proper wages. Filed by two former repossession agents who worked with the defendant through summer 2016, the complaint alleges the plaintiffs and others were not paid mandatory time-and-a-half overtime wages for all hours worked past 40 each workweek. Instead of appropriate overtime pay, the lawsuit claims the defendant paid proposed class members “a commission of 25 percent of the repossession fee” the company earned by the financing company for each repossessed vehicle.
