A former server alleges Lola's Gourmet failed to pay minimum and time-and-a-half overtime wages while applying an improper tip credit to workers' pay.
Lola’s Gourmet, LLC and two individuals with control over the restaurant are the defendants in a former server’s lawsuit in which the plaintiff claims she was not paid proper minimum or overtime wages. The plaintiff, who the case says worked for the defendants from March through November 2017, alleges the defendants not only failed to pay her time-and-a-half overtime for frequently working 40-plus hours per week, but applied an improper tip credit to her pay in violation of the Fair Labor Standards Act (FLSA). The plaintiff claims the defendants did not allow her to take the tips she earned on a “free and clear” basis as the restaurant, for example, improperly reduced the woman’s tips by “passing along vendor credit card charges to her,” the complaint reads. The case further charges that the defendants unlawfully failed to keep accurate time records of all employees’ hours worked.
