Brown v. Forrester et al
Filed: July 19, 2018 ◆§ 8:18cv1772
A lawsuit seeking allegedly unpaid wages has been filed against Omni Management Group, All Seasons Travel and Resort, and two individual owners.
Florida
A proposed collective and class action seeking allegedly unpaid wages has been filed against Omni Management Group LLC, All Seasons Travel and Resort Inc., and two individual owners. The suit was filed by two employees who worked for the defendants from May 2018 to June 2018, and November 2017 to the present, respectively. Both plaintiffs allege they were deprived of minimum wages and time-and-a-half overtime pay.
The plaintiffs claim they regularly worked more than 40 hours per week selling vacation packages out of a call center owned by the defendants, though their paystubs never reflected more than 40 hours of work. They further allege they received just $200 per week – less than the minimum wage per hour worked – if they failed to meet a designated sales quota. The complaint claims that one plaintiff was “strangely classified” as a “salaried” employee despite being subject to deductions for being late or leaving early and changes in her pay based on sales and hours. The lawsuit seeks to recover allegedly unpaid minimum and overtime wages pursuant to the Fair Labor Standards Act.
