A proposed class action lawsuit claims defendant T.T.K.M., Inc., which does business as Arby’s in Vero Beach, Florida, and its owner failed to pay workers proper overtime wages in violation of the Fair Labor Standards Act (FLSA). The plaintiff behind the suit, a former cashier who worked for the defendants from March 2014 through February 2017, claims she and similarly situated employees regularly worked upward of 40 hours per week without being paid at the time-and-a-half hourly rate for all hours over 40. Instead of proper time-and-a-half, proposed class members were paid their straight time wages for all hours worked over 40 in a workweek, the lawsuit says. According to court documents, the plaintiff says she is owed in the neighborhood of $4,300 in unpaid overtime.
