Surfside Coffee Company, LLC, which operates roughly 70 Dunkin' Donuts stores in FL, is the defendant in a proposed wage and hour class action.
Surfside Coffee Company, LLC, which, with nearly 70 stores under its oversight, operates the largest Dunkin’ Donuts franchise network in Florida, and its owner are the defendants in a proposed class action filed by three plaintiffs who claim they’re owed unpaid overtime wages. The plaintiffs, who filed the suit on behalf of current and former retail store-level managerial employees, allege their job titles weren’t entirely representative of their actual day-to-day work tasks, which the lawsuit claims were very similar to those of non-managerial employees.
According to the case, the defendants employed proposed class members “under the title and auspices” of store managers as a means to (improperly) classify the workers as exempt from overtime pay under the Fair Labor Standards Act (FLSA).
“In fact, [the plaintiffs], and those current and former employees similarly situated to [the plaintiffs], are and were inappropriately and improperly classified as exempt employees, inasmuch as at no time material hereto did they have management as their primary duty,” the case alleges.
