Florida
M & J Construction Company of Pinellas County, Inc. and an individual owner are facing a proposed collective action filed by a former carpenter and foreman who worked for the defendants between January 2011 and May 2017. Citing alleged violations of the Fair Labor Standards Act, the suit claims the plaintiff and similarly situated employees were unlawfully required to work before and after their scheduled shift times without being compensated for the extra hours. In addition, the plaintiff claims he regularly worked more than 40 hours per week and did not receive time-and-a-half overtime wages for the hours he worked above 40.
