The plaintiff worked at the defendants’ Air Kicks store as a sales associate and clerk from March 2012 through March 2018, the suit says. The man claims he was required to work in excess of 40 hours during virtually every week of his employment without being paid time-and-a-half overtime. According to the lawsuit, the plaintiff was instead paid at his straight-time rate for hours worked past 40 each week.
During the time period relevant to the case, the plaintiff worked around six days per week, from 9:30 a.m. until 8:30 p.m., reportedly without a scheduled, uninterrupted break each day. The suit states the plaintiff put in 63 hours per week at Air Kicks, with his hourly pay ranging from $7.50 up to $11.11 for every hour he worked.
