Falcon Farms, Inc. is facing a former employee’s claim in a lawsuit that he was underpaid for many of his hours worked.

The plaintiff says he worked for the flower distribution company as a delivery driver between January 2016 and December 2017. Though he was paid $11 per hour with an overtime rate of $16.50, the man claims the defendant altered his paystubs to reflect that he worked fewer hours than he actually put in each week. The plaintiff estimates that he put in an average of 50 hours per week yet, according to the suit, the defendant denied him pay for some of those hours while paying out some of his overtime hours at his straight-time rate. Further, the plaintiff claims Falcon Farms automatically deducted one hour from his time each day for lunch breaks he was unable to take.
The lawsuit says the plaintiff complained to his supervisor on many occasions about the company’s allegedly illegal pay practices but was told: “Here, we pay like that, those are your hours for this check, take it or leave.”
On December 26, 2017, the case continues, the plaintiff got into an argument with a co-worker and was fired, which he believes was in retaliation for his wage complaints.
