A lawsuit claims the chemical agent disposal company failed to pay proper wages as the result of time spent by employees performing off-the-clock work.
Three former Battelle Memorial Institute employees have filed a lawsuit against the non-profit research and development firm in which they allege individuals employed as monitoring technicians and/or demilitarization technicians have not received proper wages.
According to the complaint, Battelle Memorial Institute is a government contractor that monitors the disposal of chemical agents used for warfare. The plaintiffs, who the suit says conducted critical air monitoring for chemical agents out of the Pueblo Chemical Agent-Destruction Pilot Plant in Colorado, claim the unpaid wages, including overtime, stem from off-the-clock hours worked that went unrecorded on the company’s time clock or timesheets used to calculate payroll. Battelle workers, the case says, were required to remain on active duty during meal breaks, during which they had to respond to calls and perform other tasks.
