Ex-Employee Files Suit Against DeKalb Medical Center Over Alleged Off-the-Clock Work, Unpaid OT

A former employee of DeKalb Medical Center has moved to renew a previously dismissed suit filed against the company alleging wage and hour violations.
A former employee of DeKalb Medical Center, Inc. has moved to renew a previously dismissed proposed collective action filed against the company alleging unpaid overtime wages stemming from off-the-clock work.
Despite putting in 69 hours each week during her tenure, the plaintiff was only paid for the 40 hours she was scheduled to work, the suit alleges. According to the complaint, she “frequently worked prior to clocking in, past the end of scheduled shifts, and worked from home in order to meet expectations.” The suit charges that the defendant was aware of the plaintiff performing off-the-clock work and that the practice was even encouraged by the woman’s supervisor.
When the plaintiff complained to her supervisors about “not being paid for all the hours she worked,” the defendant disciplined her for complaining “instead of rectifying its FLSA [Fair Labor Standards Act] violation,” the case says.
