Kirkman v. Investors Bancorp, Inc.
Filed: October 16, 2020 ◆§ 3:20-cv-14574
Investors Bancorp, Inc. has failed to pay employees proper wages for off-the-clock opening duties performed prior to clocking in each shift, a lawsuit alleges.
New Jersey
Investors Bancorp, Inc. has failed to pay employees proper minimum and overtime wages for off-the-clock opening duties performed prior to clocking in for each shift, a lawsuit alleges.
The plaintiff, who worked for Investors Bank as a customer service associate supervisor between September 2017 and October 2019, says she and other supervisors, customer service associates, universal bankers and other similarly titled non-exempt employees were required to perform various tasks for which they were not paid whenever they were assigned to open the bank.
According to the case, the hourly paid workers performed “significant safety procedures” both inside and outside of the building prior to clocking in. Once the security check was complete, the employees were required to turn on their computers, open up the timekeeping webpage, log in, and then clock in for the day, the suit claims.
Per the complaint, all of the aforementioned duties were performed off-the-clock and went uncompensated.
In addition to regular wages, employees are owed unpaid time-and-a-half overtime pay for the weeks during which their off-the-clock work caused their hours to exceed 40, the lawsuit argues.
The case alleges violations of the federal Fair Labor Standards Act as well as several New Jersey wage and hour laws.
