A former employee alleges Disano Construction Co. failed to pay proper time-and-a-half hourly overtime.
Disano Construction Co., Inc. and one individual with management of the company are the defendants in a former employee’s proposed collective and class action seeking allegedly unpaid overtime wages. The plaintiff, who the case says worked for the defendants from 2003 until August 2016, says he was paid $17.50 per hour no matter how many hours over 40 he worked each week, which typically amounted to between 60 and 62.5 weekly hours worked. The lawsuit, which cites possible Fair Labor Standards Act (FLSA) violations, claims there are more than 200 others who may have experienced similar alleged overtime wage deprivation.
