A lawsuit filed against Island Transportation Corporation claims a former employee was not paid properly for his straight-time and overtime work.
A lawsuit filed against Island Transportation Corporation and four individuals with control of the business claims a former employee was not paid properly for his straight-time and overtime work.
Behind the complaint is a former driver for the Brooklyn-based company who alleges he worked between 62.5 and 84 hours per week without appropriate wages. According to the suit, the man was paid the same hourly rate for all hours worked instead of receiving time-and-a-half pay for his overtime hours. The plaintiff’s wages were also subject to unlawful deductions whenever the defendants “found an error or any irregularity in the truck,” the case alleges.
The lawsuit further claims the defendants didn’t maintain any timekeeping records and issued the plaintiff inaccurate paystubs that misrepresented his hours. Additionally, the plaintiff says he was not properly reimbursed for credentials and certifications he was required to renew in order to perform his job.
