Vargas v. Guiliano Environmental, Llc et al
Filed: January 15, 2019 ◆§ 3:19cv513
Guiliano Environmental is facing a lawsuit filed by an ex-crew foreman who claims he was not paid appropriately for overtime work.
Guiliano Environmental, LLC and the construction company’s owners are the defendants in a proposed collective and class action filed by an ex-crew foreman who claims he was not paid appropriately for overtime work.
The suit says the plaintiff performed various jobs including roofing, demolition and snow removal. According to the case, the man was typically paid by check for his first 40 hours each week. When it came to overtime work, however, the man claims he was paid in cash at his regular hourly rate of $26 rather than at a time-and-a-half rate.
Lastly, the complaint adds that the plaintiff was not usually paid for his “extraordinarily lengthy travel time to and from jobsites” when a job was canceled upon his arrival.
