Herald Square Market Inc. and two individuals are facing a proposed collective action filed by current employees who claim they have not received proper wages and have not been provided with required wage documents. According to the suit, the plaintiffs worked at Herald Square Market for more than 40 hours per week without receiving proper minimum, overtime, or spread-of-hours wages. They further claim that the defendants employed no method of recordkeeping prior to March 2017 and that they were not correctly paid for all the hours they worked. Even further, the suit claims that the defendants failed to provide employees with wage notices at their time of hire and weekly wage statements recording their hours and pay rate.
