Fears et al v. Auto Reflections Inc. et al
Filed: July 12, 2017 ◆§ 1:17-cv-02632-CAP
Auto Reflections Inc. and an individual have been accused of failing to pay their employees proper wages in violation of the Fair Labor Standards Act.
Auto Reflections Inc. and an individual have been accused of failing to pay their employees proper wages in violation of the Fair Labor Standards Act. The plaintiffs allegedly worked for the defendants as auto detailers and a supervisor. They say they were required to report to Auto Reflections each morning, where they would receive instructions about which car lots they were assigned to and which team members would be working with them. The workers would then travel to various locations and return to the defendant’s primary location at the end of each workday, according to the complaint. The suit claims that employees’ travel time, which amounted to approximately six hours per week, went uncompensated.
Additionally, the complaint alleges that the defendants’ time records were “perpetually inaccurate” as the company did not maintain a time keeping device on location. As a result, employees were not compensated for an average of two additional hours each week, according to the plaintiffs. This allegedly uncompensated time would sometimes cause employees’ hours to exceed 40 in one week, for which the plaintiffs seek unpaid overtime wages, the suit says.
