Ingenious Med, Inc. is the defendant in a proposed collective action that claims it owes unpaid overtime wages to employees who were misclassified as exempt from overtime pay. The plaintiff – who works for the company as a Tier 1 Product Support Specialist – says she did not receive overtime compensation until December 2016, when Ingenious informed her that her position would be reclassified as non-exempt. The suit argues that the defendant knew it had misclassified its employees and failed to pay them the overtime wages they were entitled to under the Fair Labor Standards Act.
The suit seeks relief for the plaintiff and similarly situated employees who worked for the defendant during the past three years and did not receive overtime compensation for any weekly hours worked in excess of 40.
