Manhattan Helicopters LLC and an individual with control over the company are the defendants in a proposed collective action filed by five plaintiffs who claim they and other customer service representatives are owed unpaid wages as a result of being misclassified as independent contractors. The lawsuit alleges the plaintiffs were paid between $10 and $15 per hour regardless of how many hours they worked each day or week. The plaintiffs challenge the defendants’ designation of customer service reps as independent contractors in that Manhattan Helicopter allegedly “exerted a great deal of control” over the individuals’ work, ostensibly indicating the existence of an employer-employee relationship.
The complaint alleges the plaintiffs worked in excess of 40 hours per week, more than eight hours per workday, without being paid time-and-a-half overtime wages. Moreover, the case says the plaintiffs were not permitted to take rest breaks during shifts and were required to pay for their own internet connections and mobile phones to work for the defendants.
