K.C. Beauty Corp Bloom Spa (which does business as Bloom Hair and Nails Spa) and two individual owners are facing a proposed collective action filed by an employee who claims the defendants violated federal and state labor laws.

Beauty Corp Bloom Spa (which does business as Bloom Hair and Nails Spa) and two individual owners are facing a proposed collective action filed by an employee who claims the defendants violated federal and state labor laws. The plaintiff, who is employed as a nail tech and masseur, says he routinely works more than 40 hours per week without receiving overtime pay. He further claims that the defendants are not entitled to take a tip credit from his wages because they failed to provide him notice of the tip credit and do not maintain a record of customer tips. According to the complaint, the defendants deduct $15 in tips from the plaintiff’s wages every day and are allegedly still in possession of a gold bracelet given to him by a customer in exchange for his services.
On top of that, the suit argues that the defendants deny the plaintiff spread-of-hours wages and fail to provide accurate wage statements/notices in accordance with the New York Labor Law.
