A lawsuit filed in Arkansas claims Stonemark Management failed to pay leasing consultants and assistant managers properly calculated overtime wages.
Stonemark Management, LLC finds itself as the defendant in a proposed class and collective action filed in Arkansas in which the plaintiff claims she and other individuals employed as leasing consultants and assistant managers were not paid proper overtime wages. Citing possible Fair Labor Standards Act (FLSA) and Arkansas Minimum Wage Act violations, the lawsuit claims the defendant failed to take into account non-discretionary bonuses—fixed amounts paid to workers who hit certain performance goals—when calculating employees’ hourly overtime pay rates.
