New York
Tandoori North Inc. and two individual owners have been named as defendants in a proposed collective action lawsuit filed by a current employee of their restaurant Indigo Indian Bistro who claims the parties have denied him entitlements he should have received under state and federal labor laws.
The plaintiff says he has worked in the positions of cook, dishwasher, porter, waiter, and delivery worker since he began working for the defendants, but has not been paid proper minimum, overtime, or spread-of-hours wages. He claims he regularly works 78 hours per week and receives a fixed weekly salary of $400 (which was raised from $350 in May 2015). According to the complaint, the defendants never informed the plaintiff that they would be applying a tip credit to his wages, and he says he is not eligible for a tip-credit because he spends more than 20 percent of each day performing non-tipped duties.
Additionally, the suit claims the defendants, on more than one occasion, have been late in paying the plaintiff his wages, have denied him meal breaks, and have not provided him with required wage statements.
