Adecco USA, Inc. and Restaurant Revolution Technologies, Inc. (RRT) are facing an employee’s proposed collective and class action in which the woman claims she is owed unpaid wages for substantial time spent performing off-the-clock work.
RRT operates a takeout order processing business for restaurants across the country to which staffing agency Adecco assigns workers, the case notes. The plaintiff says she works from home for the companies as a virtual server responsible for taking customer calls and processing takeout orders. According to the lawsuit, the plaintiff and other virtual servers are required to perform extensive off-the-clock work, such as logging into and out of required computer applications and resolving technical issues, for which they are not paid. Further, the case claims servers are often “kicked out” of the defendants’ timekeeping system when technical problems arise or if they take too long processing an order – time for which they are allegedly not paid but are still required to work.
Lastly, the lawsuit argues that the defendants don’t include bonuses in employees’ “regular rate of pay” when calculating their time-and-a-half overtime rates, thereby underpaying them for their overtime hours.
