The owners and operators of El Basurero and Ritmos 60’s have been named as defendants in a proposed collective action that takes issue with the neighboring restaurants’ pay practices.
The owners and operators of El Basurero and Ritmos 60’s have been named as defendants in a proposed collective action that takes issue with the neighboring restaurants’ pay practices. The plaintiffs – who worked as a cook and a salad preparer – claim they weren’t paid according to federal minimum and overtime wage requirements despite working more than 40, and sometimes up to 81, hours per week. Additionally, the case claims the plaintiffs were denied premium wages when they worked more than 10 hours per day in alleged violation of the New York Labor Law.
The plaintiffs further argue that they were sometimes required to continue working after they were scheduled to leave and weren’t paid for the additional hours they spent working. On top of that, the case adds, the defendants deducted one hour of pay each day for meal breaks even though one plaintiff never took breaks and the other rarely did. Both workers, according to the complaint, were required to sign documents falsely stating their hours worked each week in order to get their paychecks.
Furthermore, the plaintiffs claim they were required to purchase various items necessary to perform their job duties – such as shoes, boots, pants, and medicines – without being reimbursed for the expenses they incurred.
