The former employees claim Gallagher Construction Group and its owners unlawfully misclassified them as subcontractors exempt from OT pay.

Gallagher Construction Group LLC, Gallagher Marketing Group, LLC and the companies’ two owners are the defendants in a proposed class action filed by eight former employees who claim they’re owed unpaid wages due to being misclassified as subcontractors exempt from overtime pay. The construction worker plaintiffs each claim they regularly worked more than 40 hours each week without proper time-and-a-half overtime, and were fired by the defendants without being paid correct wages for all hours worked remodeling apartment buildings.
The lawsuit alleges violations of the Fair Labor Standards Act (FLSA), as well as Illinois’ Minimum Wage Law and Wage Payment and Collection Act.
