Out of Florida comes a proposed class action that claims East Ridge Retirement Village, Inc. and an individual with control of the business have denied employees proper overtime wages. The plaintiff in the case, a senior living salesperson who currently works for the defendants, alleges she puts in an average of 58 hours per week but is only paid for the first 40. Under the Fair Labor Standards Act, the case argues, the woman should be paid one and one-half times her regular rate of pay – which she says ranged from about $36.91 to $51.68 per hour during the past three years – for all her overtime hours.
