Butler v. Kanis Estates, LLC et al.
Filed: October 12, 2018 ◆§ 4:18-cv-00760
The operators of a Little Rock, Arkansas Dunkin’ Donuts have been named in a proposed class and collective action filed by a worker who claims he and other employees weren't paid for any hours they worked in excess of 40 each week.
The operators of a Little Rock, Arkansas Dunkin’ Donuts have been named in a proposed class and collective action filed on behalf of hourly paid employees who worked for the defendant Kanis Estates, LLC during the past three years. According to the lawsuit, the workers were not paid for any hours they worked in excess of 40 each week despite state and federal overtime requirements.
The suit says the plaintiff and similarly situated employees were responsible for operating kitchen equipment, working the cash register, serving food, and cleaning the restaurant. When the workers put in more than 40 hours of work within one week, the defendants would allegedly alter their time records and remove “hours or even days” of work from the individuals’ entries. The lawsuit argues that this policy and practice violates state and federal law, which entitle hourly paid workers to premium time-and-a-half wages for overtime hours.
